US Supreme Court Blocks Federal COVID Vaccine Mandate for Businesses

Supreme Court Reversed Federal COVID Vaccine Mandate for Businesses

The United States halted the Biden government’s major push to boost the Coronavirus vaccination rate of the country. The recently blocked mandates compulsive workers at large businesses to get a vaccine shot or face weekly testing and wear a face mask on the job. Simultaneously, the Court allows the government to proceed with a vaccine mandate for most health care workers in the United States.

In addition, the Thursday court’s order came during a spike in COVID-19 cases amid the highly contagious Omicron variant. As a result, the conservative majority of the Court concluded the federal government breached its authority by seeking to impose the Occupational Safety & Health Administration (OSHA)’s vaccine or test rule on the affected. The regulatory agency projected that the rule would save sixty-five hundred lives and prevent two hundred fifty-thousand hospitalizations over six months.

Moreover, the conservatives wrote an unspecified opinion that OSHA never enforced such a mandate or a Congress. Although Congress imposed enacted significant legislation tackling the Coronavirus pandemic, it rejected to endorse any measure similar to what OSHA proclaimed here. On the other hand, three liberals of the Court argued that the Court was deceiving by substituting its ruling for that of health experts.

The Court Displaces the Rulings of the Governmental Officials

Without legal basis and acting beyond its competency, the U.S. Supreme Court blocks the judgment of the Administration officials given the responsibility to respond to workplace health agencies, Justices Sonia Sotomayor, Stephen Breyer, and Elena Kagan wrote in a joint dissent. Additionally, business groups attacked the emergency regulation of OSHA as too expensive and possibly caused workers to leave their jobs at a time when getting new employees already is problematic. The largest retail trade group of the United States, the National Retail Federation, called the verdict of the Supreme Court a significant victory for employers.

The vaccine directive covers all health care workers virtually in the United States, applying to providers that receive Medicated or federal Medicare funding. Furthermore, it affects 10.4 million employees at seventy-six thousand health care facilities in addition to home health care providers. However, the rule has religious and medical exemptions.
