On Tuesday, the United States Supreme Court denied a bid from Pennsylvania Republicans to block certification of the poll results of the commonwealth, delivering a close fatal blow to the long-shot bid of GOP to overturn President-elect Joe Biden’s win. The action of the Supreme Court is a big loss for U.S. President Donald Trump, who regularly touted the potential of the high court to invalidate his election loss.

The president made a direct appeal to Supreme Court members and state officials just a few hours before the release of the court order to support him in his efforts to sabotage the will of voters, as he repeatedly and misleadingly suggested massive voter fraud during the November election. Trump says that let’s see whether see or not anyone has the courage, whether it’s legislatures or representatives or a justice of the Supreme Court or bench of justices of the Supreme Court, to do what everyone in this country knows is right.
One-line order of the Supreme Court issued on Tuesday with no noted dissents or remarks from any of the nine justices. Moreover, the court consists of six conservative justices – including three nominees from Trump (such as Neil Gorsuch, Amy Coney Barret, and Brett Kavanaugh) – and three liberals. The order marked the first vote of Barrett on an election-related clash. The instant action with no public opposition is an indication the Supreme Court may not want to involve in the current Trump challenges, according to Steve Vladeck, the University of Texas Law professor and CNN Supreme Court analyst.
Steep odds for the Republican party
The effort from the GOP representatives of Pennsylvania faced steep odds at the U.S. Supreme Court, specifically because the matter turned mostly on disputes of state law. In addition, the Supreme Court of Pennsylvania discharged the challenge previously, holding that Representative Mike Kelly and others bringing the suit failed to file their bid in an appropriate manner.
Kelly’s lawyers claimed that the Pennsylvania Supreme Court violated his right to put petition and right to due law process, guaranteed by the 1st and 14th Amendments of the United States Constitution, correspondingly, by shutting down all avenues of relief for past and future harms. On the other side, the officials of Pennsylvania called the Republican petition “fundamentally frivolous.”
Bart Delone, the state’s chief deputy attorney general, argued that no court ever issued an order invalidating a certification of presidential election results from the governor. The loss of public trust in the United States’ constitutional order resulting in this type of judicial power would be incalculable. Justice Samuel Alito, who jurisdiction over the Pennsylvania courts, addresses the emergency petition from the representatives. Tuesday’s court action comes after weeks of anxious appeals along with groundless conspiracies backed by President Trump and his allies that Biden stole his second term. Even though there is no authentic evidence for him to do so, Trump said in Georgia Saturday evening that they will still win it. At this stage, the lawsuits of Trump campaigns dropped and dismissed at a furious pace. Several sources previously inform CNN that there was a sense emerging within the legal team of Trump that their efforts are coming to an end.
Whereas, last week, Trump said in a forty-six-minute video released that they would continue to file suits, his legal team held some meetings and strategy calls in the previous few days. Still, the staunchest defenders of the president on Capitol Hill are influencing him not to concede even after the Electoral College vote win of Biden next week, calling on him to combat it out all the way to the floor of the House in January 2021.
